Acceptance of Terms
By accessing or using Choral Network, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the platform.
We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Continued use of the platform after changes constitutes acceptance of the revised terms.
Eligibility
Users must be at least 16 years old to use Choral Network. Users under 16 may not create accounts or use the platform. Choral Network is not intended for children under 16.
By registering, you represent and warrant that you meet the foregoing eligibility requirements.
User Accounts
When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorised access to or use of your account. We reserve the right to disable accounts that have been inactive for an extended period, or accounts that violate these terms.
Account deletion is not yet available as a self-service feature. If you wish to delete your account, please contact us at support@choral.network.
User Responsibilities
You agree that you will not:
- Use the platform for any unlawful purpose or in violation of any applicable law
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
- Interfere with or disrupt the platform, its servers, or networks
- Attempt to gain unauthorised access to any part of the platform
- Use automated means (bots, scrapers, crawlers) to access the platform without our prior written consent
- Harvest or collect email addresses or other contact information of other users for unsolicited communications
- Upload or transmit viruses, malware, or any other harmful code
Content Ownership
You retain ownership of all content that you create, upload, or post to Choral Network, including profile information, choir profiles, messages, and uploaded files.
By uploading content, you grant Choral Network a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, display, and distribute that content solely for the purpose of operating and improving the platform. This licence ends when you delete the content or your account.
Choral Network retains all rights to the platform itself, including its design, code, branding, and functionality.
Uploaded Content
You are solely responsible for all content you upload to the platform, including profile photos, choir media, learning materials, audio recordings, and documents.
By uploading content, you represent and warrant that:
- You own the content or have the necessary rights to upload it
- The content does not infringe any third-party rights
- The content complies with these terms and applicable law
- The content is accurate and not misleading
We do not claim ownership of your uploaded content. However, we reserve the right to remove content that violates these terms or that we deem inappropriate for the platform.
Copyright Obligations
Choral Network respects intellectual property rights. You must not upload, share, or distribute content that infringes the copyright, trademark, or other intellectual property rights of any third party.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us at support@choral.network with the following information:
- A description of the copyrighted work you claim has been infringed
- The location on the platform where the infringing material is found
- Your contact information
- A statement that you have a good-faith belief that the use is not authorised
- A statement that the information in your notice is accurate
We will respond to valid copyright complaints in accordance with applicable law and may remove infringing material and terminate repeat infringers.
Learning Materials and Sheet Music
Choral Network provides tools for choirs to organise and share learning materials. You are solely responsible for ensuring that any sheet music, scores, or instructional materials you upload comply with copyright law.
Specifically, you must not upload:
- Copyrighted sheet music or scores without the publisher's or composer's permission
- Reproductions of copyrighted works that exceed what is permitted under fair dealing or fair use provisions
- Any material that violates the intellectual property rights of composers, arrangers, or publishers
We encourage users to share original compositions, public domain works, or materials for which they have obtained the necessary licences. Choral Network is not responsible for copyright violations arising from user-uploaded learning materials.
Messaging Rules
Choral Network enables direct messaging between users and choirs. By using the messaging features, you agree to the following rules:
- Messages must not contain unlawful, defamatory, abusive, threatening, or harassing content
- You must not use messaging to send spam, unsolicited advertising, or promotional material
- You must not distribute malware or harmful links through messages
- You must respect the privacy of other users and not share private messages without consent
We reserve the right to monitor messages for compliance with these terms and to investigate reports of abuse. We do not routinely read private messages, but may access them when investigating violations.
Community Guidelines
Choral Network is a community built on respect, collaboration, and a shared love of choral music. All users are expected to conduct themselves in a manner that fosters a positive and inclusive environment.
The following behaviour is prohibited:
- Harassment, discrimination, or intimidation of any kind, including on the basis of race, gender, religion, nationality, disability, sexual orientation, or musical background
- Posting content that is hateful, violent, sexually explicit, or otherwise inappropriate for a professional musical community
- Deliberately misleading other users, choirs, or organisers
- Abusing the matching, invitation, or event application systems
- Creating fake profiles, choirs, or opportunities
Choir directors and administrators are responsible for maintaining appropriate conduct within their choirs and for taking reasonable steps to address violations by their members.
Account Suspension
We may suspend or restrict your access to Choral Network at any time, with or without notice, if we believe you have violated these terms, applicable law, or the rights of other users.
Reasons for suspension include, but are not limited to:
- Repeated or serious violations of these terms
- Abuse of platform features or other users
- Copyright infringement or intellectual property violations
- Fraudulent activity or misrepresentation
- Security threats or attempted unauthorised access
During suspension, you may be unable to access your account, participate in choirs, send messages, or use other platform features. We will notify you of the suspension reason where practicable.
Account Termination
You may terminate your use of Choral Network at any time by discontinuing access to the platform. Because self-service account deletion is not yet available, please contact us at support@choral.network if you wish to have your account and associated data deleted.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these terms. Upon termination:
- Your right to use the platform will cease immediately
- We may delete or archive your content and account data
- Choirs you own may become inaccessible unless ownership is transferred
- Provisions that by their nature should survive termination shall remain in effect
Limitation of Liability
To the maximum extent permitted by applicable law, Choral Network and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the platform.
Our total liability to you for all claims arising out of or relating to these terms shall not exceed the amount you have paid to us in the 12 months preceding the event giving rise to liability, or €100 if you have not made any payments.
The limitations above do not apply to liability for gross negligence, wilful misconduct, fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
Disclaimer of Warranties
Choral Network is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, about the reliability, availability, accuracy, or suitability of the platform for any particular purpose.
We do not warrant that:
- The platform will be uninterrupted, secure, or error-free
- Any defects or errors will be corrected
- The platform is free of viruses or other harmful components
- The results of using the platform will meet your expectations
You use the platform at your own risk. We encourage you to maintain backups of any important content you upload.
Governing Law
These Terms are governed by the laws of Italy.
Any disputes will be handled in accordance with applicable Italian law. Jurisdiction and venue will be determined according to the applicable legal requirements at the time of the dispute.
If any provision of these terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
